2) Public Hearing

2.1) Adopt Resolution Approving Marin Sanitary Service Rate Increase and Franchise Agreement Amendment. Adoption of the resolution amending the Franchise Agreement, increasing MSS rates and is not a project under California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(4), because the Town’s rate approval relates to the funding mechanism of on-going solid waste collection services, which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.

Council Business Items:

2.2) Receive the General Plan Update: Draft Goals, Policies, and Actions (Part 1). Receipt of a presentation about the GPU and the ensuing discussion about the draft GPAs for the GPU is not a “project” under CEQA, because it does not involve an activity which has the potential to cause a direct or reasonably foreseeable indirect physical change in the environment. (Cal. Pub. Res. Code § 21065). The draft GPAs will be evaluated in the Program Environmental Impact Report prepared for the General Plan Update prior to final adoption.
